CRUCILLO vs. OMBUDSMAN

Quoted hereunder, for your information, is a resolution of this Court dated JAN 10 2005 .
G.R. No. 159876 (Dino A. Crucillo vs. Office of the Ombudsman (Office of the Special Prosecutor) and The Presidential Commission on Good Government (PCGG) and G.R. No. 159877 (Jose R. Tengco, Jr. vs. Hon. Simeon Marcelo, etc. et al.)
Before this Court is an Urgent Motion for Permission to Travel Abroad filed by Rafael A. Sison, a co-accused of herein petitioner Dino A. Crucillo in Criminal Case No. 26539 presently pending before the Sandiganbayan, praying that this Court grant him authority to travel to the United States of America from January 10, 2005 to January 30, 2005.
On December 17, 2004, the Sandiganbayan (5th Division) denied a similar motion thereat filed by movant Sison, presumably by reason of a Temporary Restraining Order (TRO) issued by this Court on January 26, 2004 restraining the Sandiganbayan� from hearing Criminal Case No. 26539. Movant Sison must have addressed his instant motion to this Court by reason of said TRO.
WHEREFORE, considering the urgency of subject motion, the Office of the Special Prosecutor (Ombudsman), Re: Criminal Case No. 26539, Sandiganbayan, is required to comment thereon within three (3) days from notice. The comment shall be filed personally and not by Mail. Upon the lapse of the said 3-day period, the motion shall be deemed submitted with or without comment.
