Bar Matter No. 1227 (Re: Oath-Taking of the 16th Board of Governors of the IBP.)
A.M. No. 05-5-15-SC (Re: Removal of Governor Leonard S. De Vera as Member of the Board of Governors and Executive Vice-President of the Integrated Bar of the Philippines .)
The Court Resolved to NOTE the
(a) Rejoinder dated 29 June 2005 filed by the complainant;
(b) Respondent's Manifestation (re: Complainant's Rejoinder), dated 29 June 2005 filed by respondent Atty. Leonard S. De Vera;
(c) Letter dated 20 June 2005 of Atty. Jose Anselmo I. Cadiz, National President, IBP, submitting the result of the election for the Executive Vice-President of the IBP held on 18 June 2005 and informing the Court that the duly elected Executive Vice-President for the term 2005-2007 is Atty. Feliciano M. Bautista, Governor-elect for the IBP Central Luzon Region;
(d) Letter dated 7 June 2005 of Atty. Aurora P. Sanglay, President, IBP-La Union Chapter, furnishing the Court with Resolution No. 8, Series of 2005, of the IBP-La Union Chapter, entitled A Resolution Denouncing the Withdrawal of the Petition Questioning the Legality of Republic Act 9227, Supporting Its Revival and/or Re-Filing and Imploring the Supreme Court to Apply and Uphold Due Process and the Rules of Law in Determining Whether or Not Governor Leonard S. De Vera Should Be Expelled From His Post;
(e) Letter dated 14 June 2005 of Atty. Caesar S. Europa, President, IBP-Davao City Chapter, re: Protest of the IBP-Davao City Chapter against the Unlawful Removal and Replacement of Atty. Leonard De Vera as Executive Vice President/Incoming President of the IBP National Board of Officers by the Majority of the Present Board of Governors; and
(f) Letter dated 27 June 2005 of Atty. Leonard S. De Vera, re: Third Urgent Plea to Correct a Glaring Injustice of the IBP Board of Governors; Vehement Protest to the 'Election' by the Board of Governors of a 'New Executive Vice President' (Jose Vicente B. Salazar, Governor of Bicolandia) Without Due Notice and in Patent Violation of Due Process and Pending the Resolution by the Honorable Supreme Court of the Abrupt Removal of Atty. Leonard De Vera from the Board of Governors under the Same Circumstances and Without Formal Investigation, with request that IBP Governor Jose Vicente B. Salazar be enjoined from assuming the position of Executive Vice President of the IBP and restraining him from performing the duties and functions of the said office.
