OCA vs . MATIGNAS

Sirs/Mesdames:
Quoted hereunder, for your information, is a resolution of this Court dated JUL 26 2005.
A.M. No. P-04-1775 ( Office of the Court Administrator vs. Clerk of Court II Elsie P. Matignas, MTCC, Antipolo City .)
The Court Resolved, upon the recommendation of the Office of the Court Administrator, to
(a) DIRECT Ms. Elsie P. Matignas, Clerk of Court II, MTCC, Antipolo City, to
(i) PAY and DEPOSIT the amounts of-
(1)
P251,530.00 representing solemnization fees which were not collected and
receipted;
(2)
P10,255.00 and P2,165.67 representing the balance of her
accountability in the General Fund and Judiciary Development Fund,
respectively; and
(3)
P7,700.00 representing erroneous withdrawals from the Fiduciary Fund;
(ii)
SECURE
confirmation from the Land
Bank of the Philippines, Antipolo Branch, the amount of P6,664.80 and P56.741.56
deposited to the General Fund and Judiciary Development Fund, respectively,
which were not supported with machine validated deposit slips;
(iii) ACCOUNT for the missing Official Receipts Nos. 3429451 and 5198817 which are part of the series issued for the General Fund;
(iv) SUBMIT the original and duplicate copies of canceled Official Receipts or proofs that the same were submitted with the Monthly Reports to the Accounting Division, OCA;
(v) WITHDRAW all Fiduciary Fund collections still deposited with the Municipal Treasurer's Office and DEPOSIT/TRANSFER the same with the LBP Savings Account No. 1411-0015-51 for Fiduciary Fund in compliance with SC Circular No. 50-95;
(vi)
WITHDRAW
the interest earned for
Fiduciary Fund Account in the amount of
P80, 901.22 and
DEPOSIT the same with the JDF Account; and
(vii) ACCOUNT the difference of P2,593,597.85 between the total cash that should be deposited in the Bank and the actual amount of Cash in Bank, particularly LBP Account No. 1411-0015-51 maintained for Fiduciary Fund and SUBMIT to the OCA, the validated copies of deposit slips and the schedules of unaccounted collections; and
(b) DIRECT Executive Judge Ma. Consejo Gengos Ignalaga to
(i) DESIGNATE a competent and trustworthy personnel to handle/manage the judiciary funds, in lieu of Ms. Matignas; and
(ii) STRICTLY MONITOR the designated Officer-in-Charge in the proper handling of judiciary funds.
In the meantime, Clerk of Court Elsie P. Matignas is hereby SUSPENDED INDEFINITELY as Clerk of Court of MTC, Antipolo City.
