Quoted hereunder, for your information, is a resolution of this Court dated JUN 27 2005 .
G.R. No. 148101 (Diamond Motor Corporation vs. Kainan Sa Bahay Kubo, Inc., Ching Sen Ben and Cristina Tansiong Ching.)
This refers to petitioner's Manifestation and Motion to Withdraw Petition with prayer for the approval of the Compromise Agreement attached thereto. Considering that the provision stated in the first paragraph, to wit:
1. That the FIRST PARTY hereby agrees to sell, transfer and convey that parcel of land located at the corner of Marcos Highway and Sta. Lucia property, Antipolo City, covered by Transfer Certificate of Title No. PT-77382 consisting of about Four Hundred Forty Square Meters (440 sqm).
failed to state to whom the property is sold, the Court holds in abeyance action thereon.
The parties are DIRECTED to clarify the said ambiguity and to explain why respondents Ching Sen Ben and Cristina Tansiong Ching are not included in the Compromise Agreement, within ten (10) days from notice.
