Quoted hereunder, for your information, is a resolution of this Court dated JUN 7 2005.
G.R. No. 154799 (Normita Palma, et al. vs. Commission on Audit); G.R. No. 154800 (Cynthia G. Alferez, et al. vs. Commission on Audit); and G.R. No. 155054 (Bangko Sentral ng Pilipinas vs. Commission on Audit.)
The Court Resolved to NOTE the Manifestation dated 15 April 2005 filed by the General Counsel of the Bangko Sentral ng Pilipinas, stating that (a) on 15 December 2004, the Supreme Court, in its decision of even date in G.R. No. 148208 {Central Bank [now Bangko Sentral ng Pilipinas] Employees Association, Inc. vs. Bangko Sentral ng Pilipinas and the Executive Secretary) declared as unconstitutional the continued operation and implementation of the last proviso of Section 15(c), Article II of Republic Act No. 7653, otherwise known as the "New Central Bank Act"; and (b) the decision of the Court dated 15 December 2004 has now become final and executory, thus, the disallowances of respondent Commission on Audit are now devoid of legal basis, as these are anchored on the last proviso of Sec. 15(c), Article II of R.A. No. 7653, which this Court declared as unconstitutional.
