Quoted hereunder, for your information, is a resolution of this Court dated JUN 6 2005.
G.R. No. 166368 (Nilo Budiongan, et al. vs. the Hon. Court of Appeals, et al.)
Acting upon petitioners' Motion for Reconsideration of the Resolution dated January 24, 2005 which denied their Motion for Extension of Time to file a petition for review on certiorari on the grounds of: (a) lack of statement of the material date of receipt of the assailed decision/resolution of the Court of Appeals denying the petition or motion for reconsideration thereof; and (b) failure to pay the legal research fund (UPLC) in the amount of P30.00, and finding that petitioners have complied with the aforestated procedural flaws, the Motion for Reconsideration is GRANTED. However, the Court has already denied the petition for review on certiorari subsequently filed by petitioners in the Resolution dated April 4, 2005 on the ground, among others, that the petition failed to sufficiently show that the Court of Appeals had committed any reversible error in the questioned judgment to warrant the exercise by the Court of its discretionary appellate jurisdiction in this case.
