ANIBAN vs. CRUZ

Quoted hereunder, for your information, is a resolution of this Court dated JUN 20 2005.
A.M. OCA IPI No. 04-2015-RTJ (Benjamin Z. Aniban vs. Judge Rosario C. Cruz, Branch 173, Regional Trial Court of Manila.)
Acting on the undated letter of complainant in compliance with
the directive of the Court in the Resolution dated October 11, 2004 to show
cause why he should not be held in contempt of court for filing an utterly
baseless and unfounded administrative case, and finding that there are no new
matters alleged therein to warrant the reversal of the Court's finding that the
complaint is baseless and unfounded for the complainant's explanation merely
detailed the pleadings of his case and reiterated his contentions in the
complaint that Civil Case No. 01-101132 should have been resolved by respondent
Judge; the Court, upon the recommendation of the Office of the Court
Administrator in its Memorandum dated April 22, 2005, finds complainant Mr.
Benjamin Z. Aniban guilty of CONTEMPT OF COURT and ORDERS him to pay a FINE in
the amount of P5,000.00 with STERN WARNING that a similar offense shall
be dealt with more severely.
