Quoted hereunder, for your information, is a resolution of this Court dated MAR 30 2005.
G.R. No. 154770-74 (People vs. Raniel Augusto, Jr.)
Accused-appellant is sentenced by the Regional Trial Court to suffer reclusion perpetua.
In the internal Resolution dated August 18, 2004, the Court referred the Order dated June 10, 2004 of Presiding Judge Antonio D. Marigomen, Regional Trial Court, Branch 61, Dakit, Bogo, Cebu, informing the Court of the circumstances which necessitate the continued detention of accused-appellant at the Cebu Provincial Detention and Rehabilitation Center, to Office of the Court Administrator for evaluation, report and recommendation, within ten days from notice.
Said directive was reiterated in the Resolution dated February 14, 2005. To date, the Office of the Court Administrator failed to submit its compliance of the August 18, 2004 Resolution.
Meanwhile, the reply brief of the accused-appellant was noted in the Resolution of June 16, 2004.
ACCORDINGLY, before transferring this case to the Court of Appeals per People vs. Mateo, the Court reiterates anew the directives of the Court to the Office of the Court Administrator to SUBMIT its evaluation, report and recommendation on the Order dated June 10, 2004 of Presiding Judge Antonio D. Marigomen, and to EXPLAIN delay in compliance, both within ten (10) days from notice hereof.
