Quoted hereunder, for your information, is a resolution of this Court dated MAR 14 2005.

G.R. No. 164029 (Center for Educational Measurement, Inc. vs. Leticia M. Asuzano .)

R E S O L U T I O N

On September 15, 2004, the petition for review on certiorari with prayer for TRO was denied due to late filing in view of the Resolution dated July 26, 2004 and due to petitioner's failure to pay the sheriffs fee and clerk's commission.

Now before us is a Motion for Reconsideration of the Resolution dated July 26, 2004 which denied petitioner's motion for extension to file petition for review on certiorari for lack of sufficient showing that petitioner has not lost the fifteen-day reglementary period to appeal.

Although petitioner has shown that it had filed the motion for extension to file petition for review within the fifteen-day reglementary period, the fact remains that it has failed to pay the sheriff's fee and clerk's commission.

ACCORDINGLY, the motion for reconsideration is hereby DENIED.
