ROSALES vs. ARNADO

Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated MAR 9 2005 .

Adm. Case No. 6346 (Judge Edgemelo C. Rosales vs. Atty. Audie C. Arnado.)

In the Resolution dated January 24, 2005, disposition (b) thereof reads:

. . .

(b) DEFER ACTION on respondent's motion for second extension of fifteen (15) days or until 15 November 2004 within which to file comment and the comment dated 29 October 2004 until the filing by complainant of his motion for reconsideration of the Resolution dated October 25, 2004.

Said disposition was inadvertently included. It has no relevance in the instant case.

In the Resolution dated August 25, 2004, respondent Atty. Audie C. Arnado was required to file comment on the counter-charge of Judge Edgemelo C. Rosales within 10 days from notice.

Respondent filed a first motion for extension of thirty (30) days and another motion for extension of fifteen (15) days within which to file the required comment and subsequently filed the said comment.

ACCORDINGLY, the Resolution dated January 24, 2005 is RECALLED. Another one is issued to read as follows:

The Court Resolves to: (a) GRANT respondent's motions for extension totaling forty five (45) days or until November 16, 2004 within which to file comment on the counter-charge of complainant dated September 23, 2004; (b) NOTE the aforesaid Comment; and (c) REQUIRE Judge Edgemelo C. Rosales to REPLY within 10 days from notice.

SO ORDERED.
