Quoted hereunder, for your information, is a resolution of this Court dated AUG. 30, 2006

G.R. No. 169145 (Office of the Ombudsman v. Gaspar De Vera, Barangay Chairman, Barangay 457, Zone 45, District IV, Manila.)

The Solicitor General's motion for a second extension of thirty (30) days from July 1, 2006 within which to file a report on the alleged death of respondent Gaspar de Vera and to inform the Court of the new address of said respondent's counsel is GRANTED .

On 22 August 2005, the Office of the Ombudsman filed a Petition for Review before this Court assailing the Decision of the Court of Appeals in CA G.R. SP No. 68600, dated 26 May 2004, which dismissed the administrative complaint against respondent.

In a Resolution dated 14 November 2005, the Court Required respondent to file his Comment on the Petition. However, it appears that the copies of said resolution separately sent to both respondent and his counsel were returned to this Court both unserved, with the notations "Deceased" and "RTS no such person", respectively. Thus, the Court resolved to require petitioner to inform the Court of the new address of respondent's counsel and to report on the alleged death of respondent. In compliance with said Resolution, the Office of the Solicitor General filed on 25 July 2006 a Report informing the Court that respondent Gaspar de Vera died on 06 July 2005, attaching thereto a certified true copy of the death certificate.

This is not the first time that a respondent in an administrative case dies during the pendency thereof, and in all of those previous instances, the Court ordered the dismissal of the cases ^[1] cralaw .

ACCORDINGLY, the petition is hereby DISMISSED.
