SUBJECT:
REQUEST OF THE ACTING DIRECTOR OF PRISONS TO OBSERVE RESTRAINT IN
ISSUING
ORDERS IN HOLDING NATIONAL PRISONERS AND THEIR ESCORT GUARDS IN LOCAL
JAILS.
Your attention
is
herby invited to the letter of Brig. Gen. Vicente R. Raval, Acting
Director,
Bureau of Prisons, Muntinlupa, Rizal, to the Chief Justice dated August
9, 1977, which is quoted hereunder:chanroblesvirtuallawlibrary
"This is
to respectfully
request that proper representation be made to Judges and Clerks of
Court
to observe restraint in holding national prisoners and their
escort-guards
in local jails while awaiting final promulgation of judgment and/or
extended
dates of hearing which oftentimes are spaced far apart. We believe that
it would be more economical for the government [Bureau of Prisons],
without
sacrificing justice, to hold Court hearings in succession or to order
the
prisoners and their escort-guards to return to their official station
if
the trial of their cases has been postponed and/or reset to future
dates
much later than the date of the last hearing.
"Due to the
limited
funds allocated for per diems and transportation expenses, this Office
is faced with the problems of coping with the ever-increasing expenses
for official travel of our guards and prisoners.cralaw:red
"In this
connection,
it is, therefore, requested that a Circular be issued to all Judges and
Clerks of Court restraining them from issuing order holding the return
of prisoners and their escort-guards to their place of confinement and
station respectively, in instances where the hearings of the cases of
these
prisoners have been postponed and/or reset to later dates and which
dates
were spaced far apart."
