MUNICIPAL TRIAL COURTS AND MUNICIPAL CIRCUIT TRIAL COURTS
For the information
and guidance of all concerned, We are quoting hereunder the Resolution
of the Supreme Court En Banc dated January 20, 1983 in
Administrative
Matter No. 83-1-136-CFI, Re: Designation of Atty. Cesar P. Javier as
Officer-in-Charge
and Ex-Officio Sheriff, Office of the Clerk of Court, Court of
First
Instance, Manila, to wit:chanroblesvirtuallawlibrary
"x
x x the Court resolved to [a] consider such order of Judge
Maceren
designating Atty. Cesar P. Javier as Acting Clerk of Court and Ex-Officio
Sheriff, Court of First Instance of Manila, effective January 10, 1983,
without any remuneration under such designation as a recommendation and
to approve the same; and [b] direct the Office of the Court
Administrator
to circularize to all judges of inferior courts the fact that only the
Supreme Court has the authority and power to appoint such court
personnel
and the only one who can designate the Officers-in-Charge of vacant
court
positions. However, said Judges can make recommendations to the Supreme
Court for its action and/or approval."
