TO: ALL JUDGES OF THE CFI, CCC AND JDRC AND ALL CITY AND MUNICIPAL JUDGES SUBJECT: CRIMINAL CASES FILED AGAINST MEMBERS OF THE U. S. ARMED FORCES. The attention of this Court has been called to the fact that, in the past, some American Servicemen facing criminal charges before our Courts have been transferred, or have departed from Philippine territory, pending investigation, trial or final disposition of the cases against them. In the interest of
the administration of justice and to avoid miscarriage of justice in
such
cases, you are hereby directed to advise the City or Provincial Fiscal
concerned, immediately upon the filing of criminal cases against
members
of the U.S. Armed Forces, so that said Fiscal may in turn advise the
proper
American Base Commander to place the respondent or accused on "legal
hold"
pursuant to the provisions of the Military Bases Agreement.
Strict compliance herewith is hereby enjoined. Manila,
