NO. 13 [1978]
TO:
ALL
JUDGES OF THE COURTS OF FIRST INSTANCE
SUBJECT:
VACATION DUTY OF DISTRICT JUDGES.
In connection with
the forthcoming court vacation, please inform this Court, on or before
January 31, 1979, whether you would like to be on vacation or on duty
during
April and/or May, 1979, taking into careful account the condition of
your
docket and considering Section 66 of the Judiciary Act, as amended,
quoted
hereunder:chanroblesvirtuallawlibrary
"SECTION
66. Assignment
of Judges to vacation duty. - During the month of January of each
year,
the Department Head shall issue an order naming the Judges who are to
remain
on duty during the court vacation of that year; and consistently with
the
requirements of the judicial service, the assignment shall be so made
that
no Judge shall be assigned to vacation duty, unless upon his own
request,
with greater frequency than once in three years.

After you
shall have
signified your choice of the options above referred to, no change or
amendments
thereof shall be entertained. Your failure or omission to inform this
office
of your option on the above-mentioned date shall be construed to mean
that
you will be on duty during April and May, 1979.
In this
connection,
please be advised that in view of limited funds, this Court has adopted
the policy of not allowing a Judge to be on vacation duty outside the
province
or city to which he has been permanently appointed, unless per diem and
travelling expenses are waived. No Judge, however, may be assigned on
vacation
duty to his hometown or home province. In cases where there are two or
more Judges in the same municipality or city, it is desired that an
arrangement
be made among them so that at least one Judge is on duty during any
given
period.
Your
preferential
attention and early reply hereto will be appreciated.

15, 1978.
