TO: ALL CLERKS OF COURT AND EX OFFICIO SHERIFFS OF THE REGIONAL TRIAL COURTS In view of the prohibitive cost of publication, a request was filed with this Court for the revision and/or modification of the Notice of Sale of Extrajudicial Foreclosure Petition filed with the Sheriff's Offices for publication in newspapers. It proposes to eliminate, for reason of economy, some words or phrases which are of less importance but still will comply substantially with Act 3135. Pursuant, therefore, to the Resolution of the Court En Banc dated April 3, 1984, you are hereby directed to adopt the following format: "Upon extrajudicial petition for sale under Act 3135_______filed by______against (Name and address of Mortgagor/s) to satisfy the mortgage indebtedness which as of_________amounts to P___________, excluding penalties, charges, attorney's fees and expenses of foreclosure, the undersigned or his duly authorized deputy, will sell at public auction on (date of sale) 198______at 10:00 A.M. or soon thereafter at the main entrance of the (Place of Sale) to the highest bidder, for cash and in Philippine currency, the following property with all its improvements, to wit: "Prospective buyers may investigate for themselves the title hereinabove described and encumbrances thereon. if any there be.
