SUBJECT
: VACATION
DUTY OF DISTRICT JUDGE.
Section 66 of the
Judiciary Act, as amended, provides:chanroblesvirtuallawlibrary
"Section
66. Assignment
of Judges to vacation duty. - During the month of January of each
year,
the Department Head shall issue an order naming the judges who are to
remain
on duty during the court vacation of that year; and consistent with the
requirements of the judicial service, the assignment shall be made that
no Judge shall be assigned to vacation duty, unless upon his own
request,
with greater frequency than once in three years.

Supreme
Court to prepare the necessary schedule, please inform this Office on
or
before December 31, 1979 whether you opt to take vacation or remain on
duty during the months of April and May 1980. The Supreme Court will be
guided by, but is by no means bound by your choice. Failure or omission
on your part to inform this Office leaves this Office full discretion
to
recommend to the Supreme Court who will be on duty.
It is the policy
of the Supreme Court that no Judge shall be assigned to vacation duty
with
greater frequency of more than once in three years, unless upon his own
request.cralaw:red
It is likewise the
policy of the Supreme Court not to allow a Judge to be on vacation duty
outside the province or city to which he has been permanently
appointed,
unless per diems and travelling expenses are waived. No Judge, however,
may be assigned on vacation duty to his hometown or home province. In
cases
where there are two or more Judges in the same municipality, this
Office
will entertain proposals as to who shall be on duty whether for the
entire
period or as a portion thereof to assure that at least one Judge is on
duty during any given period.cralaw:red
