NO. 8 [1985]
TO:
ALL
EXECUTIVE JUDGES OF THE REGIONAL TRIAL COURT
SUBJECT:
APPOINTMENT OF NOTARIES PUBLIC.
It has come to the
knowledge of this Court that some notaries public were able to secure
more
than one [1] commission as notary public for the same term from
different
Courts within the Metro Manila Region.
For your information
and guidance in the appointment of notaries public, attention is
invited
to the pertinent provisions of the Revised Administrative Code, to wit:chanroblesvirtuallawlibrary
"Section
240. Territorial
Jurisdiction. - The jurisdiction of a notary public in a province
shall
be co-extensive with the province. The jurisdiction of a notary public
in the City of Manila shall be co-extensive with said city. No
notary
shall possess authority to do any notarial act beyond the limits of his
jurisdiction." (Underlining supplied) [See

Section 274, Act No. 2657].and to the En
Banc
Resolution of the Supreme Court dated April 11, 1985, to wit:
"Administrative
Matter No. 85-3-7414-RTC. - Re: Query of Clerk of Court Maximo
C.
Contreras. - x x x the Court resolved to:
[a] Advise Clerk of Court x x x Contreras that
a notary
public who has already an appointment as notary public for and within
the
City of Manila or elsewhere, shall not be allowed to be commissioned as
notary public during the same term within and for Makati, Metro Manila
or vice-versa; and [b] Direct the Acting Court Administrator of
this Court to issue to all Executive Judges a circular on this matter
for
their information and guidance in the appointment of notaries public."In line with
the aforecited
provision of law and Court Resolution of April 11, 1985, you are hereby
directed to see to it that before appointing, re-appointing, or
renewing
the commission of a notary public, it should be ensured that he was not
appointed as notary public elsewhere for the same term by any other
Executive
Judge.
