Syllabus

In this case, the court construed the language of a written contract for supplying materials and labor in constructing waterworks for the City of Fort Wayne, Indiana, in regard to extra work, and an increase in the quantity of work, caused by an alteration of plan, and in regard to defects in materials furnished by the city, causing delay and expense to the contractor, and reversed the judgment of the circuit court because of an erroneous construction by it of such language.

This was an action brought by plaintiffs in error (who were plaintiffs below) to recover from defendant the cost of certain materials and work connected with the furnishing and laying of water pipes for the waterworks of the city. The case is stated in the opinion of the Court. chanrobles.com-red
