Syllabus

1. Under § 303 of the World War Veterans Act of 1924, as amended by the Act of March 4, 1925, when the insured and the beneficiary designated in a certificate of war risk insurance die successively, intestate, the commuted amount of the installments not accrued when the beneficiary died is to be paid to the estate of the insured for distribution to his heirs. The heirs are to be determined in accordance with the laws of the state where the insured resided, and as of the time of his death, and are not limited to the class of beneficiaries designated in the Acts of Congress prior to the amendment. 2. The retroactive provision of the amendment making it effective as of October 6, 1917, was within the power of Congress. White v. United states, 270 U. S. 175. P. 284 U. S. 497.
