The authority to make the determination prescribed in FAR 45.302–1(a)(4) is delegated, without power of redelegation, to the head of the contracting activity (see 601.603–70). (a) The head of the contracting activity is the agency head's designee for the purpose of FAR 45.403(a). [64 FR 43629, Aug. 11, 1999] The Procurement Executive is the agency head's designee for the purposes of FAR 45.608–6. The Procurement Executive is the agency head for the purposes of FAR 45.610–2(a).
