ADMINISTRATIVE
ORDER NO. 64-93
RE:
CREATING
A SELECTION/PROMOTION BOARD FOR THE LOWER COURTS.
Pursuant to
Sec.
9, Rule VI, of the Omnibus Rules Implementing Book V of Executive Order
No. 292, otherwise known as the "Administrative Code of 1987," a
Selection/Promotion Board is hereby created for the lower courts other
than the Court of Appeals, Sandiganbayan and Court of Tax Appeals. Such
Board shall assiduously study and screen applications for positions in
the lower courts and thereafter make recommendations thereon the
Supreme
Court for approval.
Specifically,
the
Board shall act on the following:chanrobles virtual law library
[1] When
an applicant
who is not yet in the service is recommended to a vacant position and
there
are qualified applicants thereto who are already in the service;
[2] When more
than one
(1) applicant for the same position are recommended by the Presiding
Judge;
[3] When an
applicant
recommended by an Acting Presiding Judge in his designated court is
different
from the recommendee of the permanent judge therein who is detailed to
another court;
[4] When an
applicant
recommended by the Acting Presiding Judge or by the regular Presiding
Judge
detailed in another court is different from the recommendee of the
Executive
Judge;
[5] When
the recommendee
of a judge is objected to by a co-employee or co-employees of the
nominee
belonging to the same court; and cralaw:red
[6] Such
other matters
as may be referred to the Board for resolution.cralaw:red
The
recommendation of
the Board shall prevail over that of the Presiding Judge concerned,
subject
to the approval of the Supreme Court.
The Board
shall be
composed of the following:chanrobles virtual law library
1. The
Court Administrator,
who shall be its Chairman;
2. The
Deputy Court
Administrator supervising the region where the vacancy exists, who
shall
be its Vice-Chairman, but who shall act as Chairman in the absence of
the
Court Administrator;
3. A
representative
from the Office of the Chief Justice;
4. The
Chief of the
Administrative Services or his/her representative; and cralaw:red
5. A
representative
of the Philippine Association of Court Employees [PACE] to be
designated
by the Chief Justice;
Atty. Thelma
C. Bahia,
Director III, Office of the Court Administrator, shall act as
Recorder-Secretary
of the Board.
The
Chairman shall
receive an honorarium of P250.00 per meeting, while
the
Members of the Board and the Recorder-Secretary shall each receive an
honorarium
of P200.00 per meeting.cralaw:red
This Order
shall
take effect immediately.
