REPUBLIC ACT NO. 2377
AN ACT TO AMEND COMMONWEALTH ACT NUMBERED FOUR HUNDRED AND FORTY-FOUR OTHERWISE KNOWN AS THE EIGHT-HOUR LABOR LAW, BY EXCLUDING MANAGERIAL EMPLOYEES AND OUTSIDE SALES PERSONNEL FROM THE SCOPE THEREOF, AND FOR OTHER PURPOSES.
Section 1. Sec. two of Commonwealth Act Numbered Four hundred and forty-four is hereby amended to read as follows:
"Sec. 2. This Act shall apply to all persons employed in any industry or occupation, whether public or private, with the exception of farm laborers, laborers who prefer to be paid on piece work basis, managerial employees, outside sales personnel, domestic servants, persons in the personal service of another and members of the family of the employer working for him.
"The term managerial employee' in this Act shall mean either (a) any person whose primary duty consists of the management of the establishment in which he is employed or of a customarily recognized department or subdivision thereof, or (b) any officer or member of the managerial staff.
"The term 'outside sales personnel' in this Act shall mean any person who customarily and regularly performs his duties away from his employer's established place or places of business in making or promoting, or in helping make or promote, the sales of his employer's products, and is paid either a basic compensation plus commission, or on commission only.chanrobles virtualaw library
Sec. 2. This Act shall take effect upon its approval.
