REPUBLIC ACT NO. 8659 - AN ACT
ESTABLISHING THE CENTRAL VISAYAS STATE COLLEGE OF AGRICULTURE, FORESTRY
AND TECHNOLOGY OUT OF THE INTEGRATION OF THE BOHOL AGRICULTURAL COLLEGE
IN THE MUNICIPALITY OF BILAR, THE BOHOL SCHOOL OF ARTS AND TRADES IN
THE CITY OF TAGBILARAN, THE BOHOL SCHOOL OF FISHERIES IN COGTONG IN THE
MUNICIPALITY OF CANDIJAY, THE CLARIN SCHOOL OF FISHERIES IN THE
MUNICIPALITY OF CLARIN AND THE CALAPE NATIONAL SCHOOL OF FISHERIES IN
THE MUNICIPALITY OF CALAPE, ALL IN THE PROVINCE OF BOHOL, AND
APPROPRIATING FUNDS THEREFORE |
Section 1. A state college to be known as the Central Visayas
State College of Agriculture, Forestry and Technology, hereinafter
referred to as the College, is hereby established out of the
integration of the Bohol Agricultural College in the Municipality of
Bilar, the Bohol School of Arts and Trades in the City of Tagbilaran,
the Bohol School of Fisheries in Cogtong in the Municipality of
Candijay, the Clarin School of Fisheries in the Municipality of Clarin
and the Calape National School of Fisheries in the Municipality of
Calape, all in the Province of Bohol. The main campus of the College
shall be at the Bohol Agricultural College in the Municipality of
Bilar.
Sec. 2. The College shall primarily provide higher
professional, technical and special instruction and promote research
extension services, advance studies and progressive leadership in
agriculture, fisheries, forestry, industrial technology, engineering,
arts and sciences, and other fields as may be relevant. It shall also
give primary consideration to the integration of research/studies for
the development of the Province of Bohol. Sec. 3. The supervision of the existing high school shall be transferred to the Department of Education, Culture and Sports: provided, that this high school shall be allowed to remain and operate within the campus of the College until it shall have been transferred to another location or until its students shall have been accommodated in other public or private high schools. Sec. 4. The Governing Board; Manner of
Appointment. — Sec. 5. Powers and Duties of Governing Boards. —
The governing board shall have the following specific powers and duties
in addition to its general powers of administration and the exercise of
all the powers granted to the board of directors of a corporation under
Sec. 36 of Batas Pambansa Blg. 68, otherwise known as the
Corporation Code of the Philippines: Sec. 6. Promulgation and Implementation of Policies. — The Board of Trustees shall promulgate and implement policies in accordance with the declared state policies on education and other pertinent provisions of the Philippine Constitution on education, science and technology, arts, culture and sports; as well as the policies, standards and thrusts of the CHED under Republic Act No. 7722. Sec. 7. The Administration. — The administration
of the College shall be vested in the president of the College who
shall render full-time service. He shall be appointed by the Board of
Trustees, upon the recommendation of a duly constituted search
committee. He shall have a term of four (4) years and shall be eligible
for reappointment for another term: provided, that the incumbent heads
of the component campuses before integration may stay on as deans in
charge of the administration of said particular campus subject to an
incorporating terms as may be decided upon by the Board of Trustees.
Each component campus shall be allowed a modicum of administrative and
financial autonomy to allow for operational efficiency and effectivity
but within the requirements of a harmonious and unified management of
the integrated state college for optimum benefits from limited
resources. Sec. 8. The Secretary of the College. — The Board shall appoint a secretary who shall serve as such for both the Board and the College and shall keep all records and proceedings of the Board. He shall communicate to each member of the Board notice of meetings. Sec. 9. The Treasurer of the Philippines. — The Treasurer of the Philippines shall be the ex officio treasurer of the College. Section 10. Administrative Council. — There shall be an administrative council consisting of the president of the College as chairman, the vice-president(s), deans, directors and other officials of equal rank as members, and whose duty is to review and recommend to the Board of Trustees policies governing the administration, management and development planning of the College for appropriate action. Section 11. Academic Council. — There shall be an
academic council with the president of the College as chairman and all
members of the instructional staff with the rank of not lower than
assistant professor as members. Section 12. Academic Freedom. — Pursuant to paragraph 2, Sec. 5 of Article XIV of the Constitution of the Republic of the Philippines, all institutions of higher learning, public or private, shall enjoy academic freedom and institutional autonomy. Section 13. Admission. — No student shall be denied admission to the College by reasons of sex, nationality, religion, political affiliation or physical disability. Section 14. No religious opinion or affiliation shall be the matter of inquiry in the appointment of faculty members of the State College: provided, however, that no member of the faculty shall teach for or against any particular church or religious sect. Section 15. No member of the faculty of the State College shall attempt directly or indirectly, under penalty of dismissal by the Board of Trustees, to influence students or any person in the College towards any ideology, political or otherwise, which agitates the throw of the duly constituted government. Section 16. The appointment of the officer-in-charge of the State College, pending the appointment of the President by the Board upon its composition, shall be made by the Commission on Higher Education (CHED). Section 17. On or before the fifteenth day of the second month after the opening of regular classes each year, the Board shall file with the Office of the President of the Philippines through the chairman of the Commission on Higher Education and to both Houses of Congress a detailed report on the progress, conditions and needs of the College. Section 18. All assets, fixed and movable, personnel and records of the Bohol Agricultural College in the Municipality of Bilar, the Bohol School of Arts and Trades in the City of Tagbilaran, the Bohol School of Fisheries in Cogtong in the Municipality of Candijay, the Clarin School of Fisheries in the Municipality of Clarin and the Calape National School of Fisheries in the Municipality of Calape are hereby transferred to the College: provided, however, that the positions, rights and security of tenure of personnel therein employed under existing laws prior, to absorption by the College are not impaired: provided, further, that the incumbent of the positions shall remain in the same status until otherwise provided for the Board. All parcels of land belonging to the government occupied by the Bohol Agricultural College and the other schools being integrated are hereby declared to be the property of the Central Visayas State College of Agriculture, Forestry and Technology and shall be titled under the name of the College: provided, that should the State College cease to exist or be abolished or should such parcels of land aforementioned be no longer needed by the College, the same shall revert to the Province of Bohol. Section 19. All accounts and expenses of the College shall be audited by the Commission on Audit or its duly authorized representative. Sec. 20. Heads of bureaus and offices of the national government are hereby authorized to loan or transfer, upon request of the president of the College, such apparatus, equipment or supplies as may be needed by the College, and to detail employees for duty therein when, in the judgment of the head of the bureau or office, such apparatus, equipment, supplies or services of such employees can be spared without serious detriment to the public service. Employees so detailed shall perform such duties as required of them by the President of the College, and the time so employed shall be counted as part of their official service. Sec. 21. It shall be the continuing policy of the College to accept the affiliation and/or integration within its operation of any existing national schools whose programs can contribute largely and effectively to the attainment of its objectives: provided, however, that in case of integration, the chairman of the Commission on Higher Education is hereby authorized to determine and approve the specific existing national schools that are to be integrated as part of the College. In this particular case, it is understood that all funds, properties, and other assets as well as obligations of the integrated schools shall be transferred to the College. Sec. 22. The amount necessary for the implementation of this Act shall be charged against the current year's appropriations of the Bohol Agricultural College in the Municipality of Bilar, the Bohol School of Arts and Trades in the City of Tagbilaran, the Bohol School of Fisheries in Cogtong in the Municipality of Candijay, the Clarin School of Fisheries in the Municipality of Clarin and the Calape National School of Fisheries in the Municipality of Calape, except the sum needed to continue the operations of the existing high schools. Thereafter, such amount as may be necessary for the continued operation and maintenance of the Central Visayas State College of Agriculture, Forestry and Technology shall be included in the annual General Appropriations Act. Sec. 23. All laws, presidential decrees, executive orders, rules and regulations contrary to or inconsistent with the provisions of this Act are hereby repealed, amended or modified accordingly. Sec. 24. This Act shall take effect upon its
