CIRCULAR NO. 5-2000CREATING
THE PREQUALIFICATION, EVALUATION AND AWARDS COMMITTEE FOR CONSULTANCY
(PEAC)
WHEREAS, the Supreme Court plans to construct new buildings or
expansion
of old or existing buildings, such as, but not limited to, (a) the
multi-purpose
building under the Memorandum Agreement between the Supreme Court and
the
Court of Appeals; (b) a new building of the UP side at the back of the
old SC building; (c) a new building between the Judicial Records Office
an the offices of Mr. Justice A. R. Melo and Mme. Justice M. P. G.
Reyes;
(d) an extension of the Main Library; (e) small buildings on the side
of
the Supreme Court building toward the DOJ compound, (f) additional
floor
for the Printing Services building; and (g) cottages in Baguio
City:
WHEREAS, the foregoing construction projects would involve
consulting
services for, inter alia, architectural and engineering plans/designs
defined
under the National Economic and Development Authority (NEDA) Guidelines
which provides that the procurement of consulting services for
government
projects shall be done through open competitive selection process
unless
otherwise provided under existing laws, rules and regulations such as
when
conditions exist which justify the procurement of consulting services
through
direct selection/negotiation under Section 5.10 of said
Guidelines;
WHEREAS, pursuant to the Implementing Rules and Regulations (IRR)
on
the Procurement of Consulting Services set by NEDA, "each
department/office/agency
including local government units shall have in its head office a
Prequalification,
Evaluation and Awards Committee (PEAC) which shall be responsible for
the
conduct of prequalification of consultants, evaluation of proposals,
selection
and recommendation of award of contracts"(Section
3.1.1.);
WHEREAS, under the NEDA Guidelines, the general rule on public
bidding
may be dispensed with in the procurement of consulting services for
government
projects, through "qualified bidding," in lieu of the usual
public
bidding, so that instead of the Public Bidding and Awards Committee for
Consultancy (PEAC), should be constituted;
WHEREAS, Section 3.1.2. of the aforesaid Rules provides that the
PEAC
shall be composed of the following:
a.
Chairman [regular] - At least third ranking official of
the
department/office/agency/local government unit;
b. Executive
Officer
[regular] - Legal Officer of the
department/office/agency/local
government unit;
c. Member [regular]
- Technical member designated by the head of the
department/office/agency/local
government unit;
d. Member [provisional]
- At least two (2), one of whom should be the end-user of the
services
with experience in the type of project/activity where the consultancy
is
required, duly designated by the head of the
department/office/agency/local
government unit on a project basis;
e. Member [observer]
- One observer from a non-governmental organization
will be invited.
WHEREAS, the creation of the Prequalification, Evaluation and
Awards
Committee (PEAC) is essential for the procurement of consulting
services
and to expedite the eventual construction of the aforementioned new
buildings
or expansion of existing buildings as well as any other building which
the Supreme Court may hereafter decide to construct or to
renovate.
NOW, THEREFORE, a Prequalification, Evaluation and Awards
Committee
for consultancy is hereby created to be composed of the following: 1.

- a member of a non-governmental organization to be invited by the
Committee
This Resolution shall take effect immediately.
