Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated APR 21, 1999.
G.R. No. 110049 (Herminio A. Astorga vs. Court of Appeals and Gerardo T. Syquia.)
The Court Resolved to (a) NOTE the Memorandum dated 8 April 1999 of the Clerk of Court, Atty. Virginia Ancheta-Soriano informing the Court that the record of this case has already been reconstituted in compliance with the resolution of 15 March 1999, and (b) ACCEPT the reconstituted record.
After deliberating on the issues raised and the arguments adduced in the petition (rollo, 4-30), private respondent's Comment on the petition (id., 98-102), the petitioner's Reply to the Comment (id., 105-111), and the private respondent's Rejoinder to the Reply (id., 120-124), the Court further Resolved to DENY the instant petition for failure of petitioner to sufficiently show that public respondent Court of Appeals committed any reversible error in its challenged resolutions as to warrant the exercise by this Court of its discretionary appellate jurisdiction in this case.
