Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated APR 12, 1999.
G.R. No. 126207 (Amante O. San Pedro vs. Court of Appeals, et al.)
Considering the return of compliance with the order of arrest issued by the Court against Atty. Oscar T. Pagulayan, counsel for private respondents, who was adjudged guilty of contempt of Court in the resolution of 14 September 1998, submitted by Atty. Diosdado N. Araos, Agent III, Dangerous Drugs Board, National Bureau of Investigation, Taft Avenue, Manila, dated 1 March 1999 informing that he failed to locate and arrest said subject, as well as the explanation filed by National Bureau of Investigation Director Santiago Toledo, dated 3 March 1999, in compliance with the show cause resolution of 27 January 1999, stating why he should not be held in contempt for failure to timely make aforesaid return of compliance, the Court RESOLVES to REITERATE the resolution of 14 September 1998 adjudging Atty. Oscar T. Pagulayan guilty of contempt of Court under Section 3[b], Rule 71 of the Rules of Court, and ordering his imprisonment until he complies with the Court's directive and submits the private respondent's comment on the petition for review on certiorari as required in the resolution of 14 October 1996, and DIRECT the National Bureau of Investigation to SERVE anew the Order of arrest and Commitment against Atty. Oscar T. Pagulayan and to make an immediate return of compliance therewith.
