G.R. No. 136346 (Eglantine G. Franco vs. Court of Appeals, et al.)

Acting on the compliance of petitioner with motion for reconsideration of the resolution of 20 January 1999 which treated the petition for certiorari and prohibition as a petition for review on certiorari under Rule 45 of the 1997 Rules of Civil Procedure, as amended, and denied the same for petitioner's failure to serve copy of the petition on the Solicitor General and to submit a verified statement of the date of filing of the motion for reconsideration of the assailed resolution, the Court RESOLVES to DENY the same with FINALITY, no compelling reasons having been adduced to warrant the reconsideration sought.
