Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated APR 7, 1999.

G.R. No. 136360 (Leonarda Secreto and Magdalena Secreto vs. Elisa Dollete, et al.)

From the Resolution of the Regional Trial Court dated September 16, 1998 granting the Motion to Dismiss in Civil Case No. 2973, for quieting of title and reconveyance, petitioners assails said resolution by filing a petition for review on certiorari with this Court.

Considering that petitioners had taken a wrong mode of appeal as Orders/Resolutions of the Regional Trial Court granting the motion to dismiss is appealable to the Court of Appeals and not to the Supreme Court, the Court Resolved top DENY the petition pursuant to Rule 56, Sec. 5(g).
