Quoted hereunder, for your information, is a resolution of this court dated AUG 25, 1999.

G.R. No. 126405 (Dr. Josefa E. Nepomuceno vs. Court of Appeals and the People of the Philippines.)

For resolution is a Motion for Reconsideration of the petitioner, Dra. Josefa E. Nepomuceno, of this Court's Decision dated February 25, 1999, dismissing the Petition for Certiorari.

The Decision sought to be reconsidered ruled that the Court of Appeals did not act with grave abuse of discretion in denying petitioner's Motion to Strike off the Record the OSG's Comment dated June 6, 1996 and in denying petitioner's Motion for Reconsideration.

The Court is mindful of the Constitutional mandate of speedy disposition of cases. But due regard should be given to the attendant circumstances, to the end that the interest of justice is not sacrificed.

Evidently, the Motion poses nothing new. The points raised and arguments advanced by movant merely reiterate the thrust of the petition which the Court found barren of merit, and after giving the Decision sought to be considered a second hard look, no sustainable basis for reconsideration the same is perceived.

WHEREFORE, petitioner's Motion for Reconsideration , dated March 25, 1999, is hereby DENIED with finality for want of merit.
