Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated AUG. 10, 1999.
G.R. No. 135097(Alexandra G. Bengson vs. Commissions on Elections and Teodoro "Teddy" Cruz.)
Private respondent filed with this Court on May 8, 1999 a Motion for Clarification of the Resolution * Unsigned. promulgated on April 13, 1999, dismissing the petition for certiorari in G.R. No. 135097 for being moot and academic. Private respondent sought clarification of the third sentence of paragraph 3 of our Resolution, which read:
"Moreover, he pointed out that he did make a false material representation since under Section 74 of the Omnibus Election Code, citizenship is not specifically required to be stated in the certificate of candidacy."
Private respondent asserted that there could have been a typographical error in the omission of the word "not" in said sentence since he did not state nor point out in any of his pleadings, whether in the COMELEC or in this Court, that he had made a false material representation in his certificate of candidacy.
Acting on said motion, and after consulting the rollo of the case, it does appear that the third sentence of the third paragraph of the subject Resolution should be, as it is hereby, corrected to read as follows:
"Moreover, he pointed out that he did not make a false material representation since under Section 74 of the Omnibus Election Code, citizenship is not specifically required to be stated in the certificate of candidacy."
