G.R. No. 139246 (Rogerio R. Olaguer, et al. vs. Court of Appeals and Obed C. Cutaran, et al.)

Acting on the petition for certiorari dated 02 July 1999, the Court RESOLVES to DISMISS the petition for being premature for petitioners' failure to file a motion for reconsideration of the questioned decision of the Court of Appeals prior to availment of the special civil action of certiorari and for lack of sufficient allegations to bring the case within the recognized exceptions to this rule.
