[ G.R. No. 139515. August 30, 1999]
CONSTELLATION SHIPMANAGEMENT CO., LTD, et al. vs. HENRY CHAN.
SECOND DIVISION
Gentlemen:
Quoted hereunder, for your information, is a resolution of this court dated AUG 30, 1999.
G.R. No. 139515 (Constellation Shipmanagement Co., Ltd./Interorient Maritime Enterprises, Inc. and Times Surety and Insurance Co. vs. Henry Chan.)
Acting on the petition for review on certiorari with prayer for the issuance of temporary restraining order and/or writ of preliminary injunction dated 13 August 1999, the Court RESOLVES to DENY the petition for lack of merit and for being manifestly prosecuted for delay pursuant to the second paragraph of Section 5, Rule 45, and Section 5(b), Rule 56 of the 1997 Rules of Civil Procedure, as amended, as the petition, in fact, failed to sufficiently show that the Court of Appeals committed any reversible error in the questioned judgment as to warrant the exercise by this Court of its discretionary appellate jurisdiction in this case.
Very truly yours,
TOMASITA M. DRIS
Clerk of Court
