[ G.R. No. L-46522. August 9, 1999]
FILADELFO BANDIGAN vs. ECC, et al.
FIRST DIVISION
Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated AUG 9, 1999.
G.R. No. L-46522 (Filadelfo Bandigan vs. Employees Compensation Commission and the Government Service Insurance System.)
Pursuant to the directive of the Court to reconstitute the records of the instant case, Atty. Virginia A. Soriano, Clerk of Court, this Division, wrote counsel for petitioner Atty. Teodoro Nano, Jr., on November 7, 1995 requesting the latter to furnish the Court with photocopies of his records of the case. On January 19, 1996, the request was reiterated by Atty. Enriqueta Esguerra-Vidal, Assistant Clerk of Court, this Division, via telegram to Atty. Teodoro Nano, Jr. On November 6, 1996, Atty. Soriano again wrote Atty. Nano reiterating the Court's directive. This was followed by a letter from Atty. Nano reiterating the Court's directive. To this date, however, Atty. Nano has not complied with said directive.
ACCORDINGLY, the instant petition is hereby DISMISSED for non-interest and for failure of Atty. Teodoro Nano Jr. to comply with the Court's directives dated November 7, 1995, January 19, 1996, November 6, 1996, and August 3, 1998.
Very truly yours,
(Sgd.) VIRGINIA
ANCHETA-SORIANO
