[ G.R. No. 132182. February 10, 1999]
PHILIPPINE PORTS AUTHORITY, et al. vs. COURT OF APPEALS, et al.
SECOND DIVISION
Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated FEB 10, 1999.
G.R. No. 132182 (Philippine Ports Authority, et al. vs. Court of Appeals, et al.)
The motion of the Solicitor General for a third extension of thirty (30) days from December 15, 1998 within which to file his reply to respondents' comment on the petition for certiorari and his motion for an extension of thirty (30) days from January 24, 1999 within which to file his comment on respondents' manifestation and motion to dismiss the said case dated October 19, 1998 are GRANTED.
Considering the allegations, issues and arguments adduced in the petition for certiorari as well as respondents' comment thereon and the reply of the Solicitor General to the aforesaid comment, and dispensing with the Solicitor General's comment on respondents' aforesaid manifestation and motion, the Court RESOLVES to DISMISS the petition for failure to sufficiently show that the questioned judgment is tainted with grave abuse of discretion.
Very truly yours,
TOMASITA B. MAGAY-DRIS
