Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated FEB 17, 1999.

G.R. No. 135907 (Wilfredo Larga vs. Ana Mendoza.)

Considering the allegations, issues and arguments adduced in the petition for review on certiorari, the Court RESOLVES to DENY the petition for failure to sufficiently show that the Court of Appeals had committed any reversible error in the questioned judgment to warrant the exercise by this Court of its discretionary appellate jurisdiction in this case. Moreover, petitioner failed to remit the amount of P202.00 as deposit for sheriff's fee and clerk's commission in view f his prayer for a temporary restraining order, in accordance with Section 3, Rule 45 in relation to Section 5 (c), Rule 56 of the 1997 Rules of Civil Procedure as amended.
