Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated FEB 1, 1999.
G.R. No. 136330 (Dreamline Transport Philippines Corporation and/or Edgardo Yalong, et al. vs. National Labor Relations Commission, et al.)
The motion of petitioners for an extension of thirty (30) days from December 12, 1998 within which to file a petition for certiorari and their motion for leave to admit the same are GRANTED.
Acting on the petition for certiorari with prayer for the issuance of a temporary restraining order dated January 9, 1999, the Court RESOLVES to DISMISS the same pursuant to Section 1, Rule 65 and Section 3, Rule 46 in relation to Section 2, Rule 56 of the 1997 Rules of Civil Procedure, for petitioners' failure to accompany the petition with a duplicate original or certified true copy of the questioned resolution of the National Labor Relations Commission, as well as for being premature since petitioners failed to file the requisite motion for reconsideration of the assailed prior to the availment of the special civil action of certiorari, or to adduce sufficient reasons to bring the case within the recognized exceptions.
