Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated FEB 3, 1999.

G.R. No. 136767 (Norberto Torio and Nieves C. Torio vs. PDCP Development Bank, Inc., et al.)

The motion of petitioners for an extension of thirty (30) days from December 28, 1998 within which to file a petition for review on certiorari is DENIED for failure to indicate in the affidavit of service of copies of the motion on respondent and on the Regional Trial Court the place of such service in accordance with Section 13, Rule 13, in relation to Section 2, Rule 45 of the 1997 Rules of Civil Procedure; besides, the said affidavit of service is misleading and ineffectual, the date of alleged service, i.e., December 21, 1998, being in conflict with the date of actual service, i.e., December 22, 1998, as borne out by the date of the postal registry receipts.
