Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated FEB 17, 1999.
G.R. No. 136797 (Engr. Celso P. To-ong vs. Hon. Irenea E. Ceniza, et al.)
In accordance with Rule 65 and other related provisions of the 1997 Rules of Civil procedure governing petitions for certiorari, prohibition and mandamus filed with the Supreme Court, only petitioners which comply strictly with the requirements specified therein shall be entertained. On the basis thereof, the Court RESOLVES to DISMISS the petition for certiorari for failure of petitioner: (a) to pay the amount of P602.00 for deposit for costs, clerk's commission and the balance of the deposit for sheriff's fee in accordance with Section 3, Rule 46 in relation to Section 2, Rule 56; (b) to implead private respondents Salileo Escalon, et al., in the aforesaid petition in accordance with Section 5, Rule 65 and Section 4, Rule 13 in relation to Section 3, Rule 46 and Section 2 Rule 56; and (c) to submit an affidavit of service of a copy of the petition on the public respondent containing a full statement of the place of such service pursuant to Section 2(c), Rule 56, and the third paragraph of Section 3, Rule 46 in relation to the first paragraph of Section 2, Rule 56, and Section 13, and (d) a verified statement of material dates pursuant to the second paragraph of Section 3 of Rule 46.
