Quoted hereunder, for your information, is a resolution of this Court dated FEB 10, 1999.
G.R. No. 136812 (Joel R. Tulod vs. National Labor Relations Commission, et al.)
Acting on the petition for certiorari, The Court Resolves to DISMISS the same pursuant to Section 3, Rule 46, in relation to Section 2(c), Rule 56 of the 1997 Rules of Civil Procedure, petitioner having failed to submit a written explanation for the non-personal service of copies of the petition on respondent and on the National Labor Relations Commission as required by Section 11, Rule 13, as well as to remit the amount of P202.00 as balance of the deposit for costs. Moreover, the petition is premature as no motion for reconsideration has been filed with respondent NLRC and there are no sufficient allegations to bring the case within the recognized exceptions.
