Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated JAN 26, 1999.

A.M. No. 99-1-02-MCTC (Re: Inhibition of Judge Conrado A. Ruiz in Criminal Case No. 2608-P.)

Acting on the Order of Inhibition, dated 18 November 1998, of Judge Conrado A. Ruiz, Municipal Circuit Trial Court, Sanchez Mira-Pamplona, Cagayan, issued in Criminal Case No. 2608-P, entitled "People of the Philippines vs. PO3 Jimmy Yatar," because the accused has engaged the services of Atty. Amelito A. Ruiz, the son of the herein presiding judge in a case for estafa now pending in the Regional Trial Court, Branch 12, Sanchez Mira, Cagayan, of which the complaining witnesses are the same in the above-entitled case and to avoid any doubt on his integrity and impartiality, the Court Resolved to: (a) DENY the order of inhibition issued on 18 November 1998 by Judge Conrado A. Ruiz, 2nd Municipal Circuit Trial Court, Sanchez Mira-Pamplona, Cagayan, issued in Criminal Case No. 2608-P, entitled "People of the Philippines vs. PO3 Jimmy Yatar"; and (b) DIRECT Judge Ruiz to hear, try and decide said criminal case with dispatch.
