NORTHWEST AIRLINES vs. NLRC, et al.

FIRST DIVISION

Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated JUN 21, 1999.

G.R. No. 108128 (Northwest Airlines, Inc., vs. National Labor Relations Commission, Tomas Masagca, et al.)

On August 1, 1984, petitioner Northwest Airlines entered into a ground handling agreement with MIASCOR where the latter would provide ground handling services to the former. About five (5) years after, or on February 27, 1989, in accordance with the terms of agreement, petitioner notified MIASCOR of the termination of the agreement. Because of this, on May 8, 1990, MIASCOR employees composed of herein private respondents, filed with the National Labor Relations Commission (NLRC) a complaint for illegal dismissal and for declaration as regular employees of petitioner Northwest.1 [Docketed as NLRC NCR Case No. 05-2551-90.]

On June 30, 1991, the labor arbiter declared private respondents as employees of petitioner and ordered the payment of backwages, salary differentials, cost of living allowance, 13th month pay, bonuses and such other benefits extended to regular employees of petitioner. On July 26, 1991, petitioner appealed the decision to the NLRC. On June 25, 1992, the NLRC modified the labor arbiter's decision by deleting the awards for moral and exemplary damages, but affirmed the rest of the decision.

Petitioner's motion for reconsideration of the NLRC decision was denied on December 7, 1992. On December 22, 1992, it filed the present petition with this Court, which until now remains unresolved.

On March 29, 1999, the petitioner and private respondents entered into a compromise agreement, with MIASCOR representing the private respondents. On April 22, 1999, the parties filed a joint motion for the approval of the compromise agreement and dismissal of NLRC Case No. 5-05521-90.2 [The parties entered into the Compromise Agreement on March 29, 1999. Though the agreement tries to settle all the other cases between the parties which are pending in the lower courts, this resolution pertains only to the one filed with the NLRC and which is the subject of the petition docketed as G.R. No. 108128.]

WHEREFORE, finding the agreement to be not contrary to law, public morals, good customs, public order or public policy, we GRANT the motion. The Compromise Agreement dated March 29, 1999 is hereby approved, and the NLRC Case No. 05-02551-90 is ordered dismissed.
