Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated MAR 1, 1999.

G.R. No. 125881 (People of the Philippines vs. Felirose Galanote and Amante Bilen).

Considering that accused-appellant Amante Bilen, who was convicted of murder and sentenced to reclusion perpetua in the appealed decision in Criminal Case No. 1164-C, had died according to the death certificate submitted by his counsel, and considering further that co-accused-appellant Felirose Galanote was sentenced only to indeterminate penalties of arresto mayor to prision correccional for attempted homicide in Criminal Case 1165-C and of prision mayor to reclusion temporal for murder in Criminal Case No. 1164-C, the Court RESOLVES to DISMISS the appeal as to accused-appellant Amante and to REFER the appeal of accused-appellant Felirose Galanote to the Court of Appeals for appropriate action and disposition.

The notice of the change of address of Atty. Roque B. Bello, counsel for accused-appellants, to No. 1547 Birmingham Street, Brookside Hills Subd., Cainta, Rizal, with request to be furnished with copies of Court processes in this case at the aforestated new address and compliance dated January 22, 1999 submitting the death certificate of accused-appellant Amante Bilen is NOTED and GRANTED.
