Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated NOV 15, 1999.

G.R. No. 127884(Raul Funilas vs. The Office of the Ombudsman, et al.)

This is a petition for review of the 18 July 1996 Resolution of the Ombudsman in OMB-ADM-O-96-0129 which imposed upon Purok Coordinator Raul Funilas of Barangay U.P. Campus, Diliman, Quezon City, the administrative penalty of dismissal for committing acts constitutive of grave misconduct. Petitioner likewise challenges the 17 January 1997 Order of the Ombudsman which denied his motion for reconsideration and/or investigation.

Since what is involved is an administrative disciplinary case, the appeal should be made to the Court of Appeals, pursuant to our decision of 16 September 1998 in Fabian vs. Hon. Aniano Desierto, G.R. No. 129742, (295 SCRA 470).

Accordingly, this case is hereby REFERRED to the Court of Appeals for appropriate action.
