Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated NOV 22, 1999.

G.R. No. 135622(Expedito S. Anipan vs. Elma F. Santillan, Commission on Elections (COMELEC), the Election Officer of the Municipality of Nabas, Aklan, the Municipal Board of Canvassers of the Municipality of Nabas, Aklan and Board of Inspectors of Prec. No. 12-A in the Municipality of Nabas, Aklan.)

"The Court Resolved to (a) NOTE the Memorandum dated 23 September 1999 filed by Atty. Francisco B. Sibayan of the Pimentel Apostol Layosa and Sibayan Law Office for private respondent Elma F. Santillan, in compliance with the resolution of 20 July 1999 and (b) DENY the motion filed by the Solicitor General for public respondents for an extension of thirty (30) days from the expiration of the reglementary period or until 1 November 1999, within which to file comment (should be memorandum), as the Office of the Solicitor General is deemed to have waived the submission of the memorandum.

After considering the allegations, issues and arguments adduced in the petition for certiorari, as well as in the comments thereon filed by the private respondent and the public respondent on October 27, 1998 and February 22, 1999, respectively, and the rejoinder to comments of respondent Santillian and reply to comments of public respondent, both filed by petitioner on December 10, 1998 and June 23, 1999, respectively, the Court failed to reach a decision for lack of the necessary votes.

Accordingly, the petition is DISMISSED. Pardo, J., took no part.
