Gentlemen:
Quoted hereunder, for your information, is a resolution dated of this Court dated NOV 22 1999.
G.R. No. 139489(Danilo B. Ferrer vs. Commission on Elections and Rafael Grospe.)
What is before this Court is a petition for certiorari under Rule 64 of the 1997 Rules of Civil Procedure, with a temporary restraining order and/or writ of preliminary injunction questioning the Resolution issued by the COMELEC second division, dated March 18,1999, and the COMELEC en banc Resolution dated July 27,1999, reversing the ruling of the Municipal Trial Court of Talavera, Nueva Ecija. The Resolutions in effect voided the proclamation of petitioner, Danilo B. Ferrer, as the duly elected punong barangay of barangay Bantug Hacienda, Talavera, Nueva Ecija and declared private respondent Rafael M. Grospe as the duly elected punong barangay.
It appearing prima facie that the COMELEC gravely abused its discretion in annulling some ballots cast for petitioner, there is need to review the revision of ballots conducted in the case.
It would be in the interest of justice to require the parties to maintain the status quo ante to afford the Court sufficient time to review the questioned resolutions.
WHEREFORE, we hereby resolved to enjoin the parties to maintain the status quo until further orders from this Court.
