[ G.R. No. 133502. October 11, 1999]
HEIRS OF FELICIDAD DIZON vs. HON. JAIME D. DISCAYA.
THIRD DIVISION
Gentlemen:
Quoted hereunder, for your information, is a resolution of this court dated OCT. 11, 1999.
G.R. No. 133502 (Heirs of Felicidad Dizon, namely, Juliana A. Dizon and Gerarda A. Albilla, represented by their Attorney-in-Fact, Romeo A. Viray, petitioner, vs. Hon. Jaime D. Discaya, Presiding Judge, Regional Trial Court, Branch 120, Kalookan City, respondent.)
At bar are petitioners' motion for Reconsideration of the Decision, promulgated in this case on February 15, 1999, affirming with modification the decision of Branch 120 of the Regional Trial Court of Kalookan City, which dismissed petitioner's petition for reconstitution of title for non-compliance with the requirements of Republic Act No. 26 ("RA26").
Evidently, the Motion poses nothing new. The points raised and arguments advanced by movants simply reiterate the trusts of their petition which has been adjudged barren of merit and after giving the same a second hard look, the Court discerns no sustainable basis for disturbing its finding and conclusion sought to be reconsidered.
WHEREFORE, for lack of merit, the petitioner's Motion for Reconsideration is hereby DENIED with finality.
SO ORDERED.
Very truly yours,
(Sgd.) JULIETA Y. CARREON
