Gentlemen:

Quoted hereunder, for your information, is a resolution of this court dated SEPT 6 1999.

G.R. No. 133564 (Sergio Barbosa, et al vs. Court of Appeals, et al.)

The copy of the resolution of 22 March 1999 addressed to Atty. Jesus Montalbo, counsel for respondents, which was returned to this Court unserved with notation "Closed House," is deemed SERVED on said counsel by substituted service pursuant to Section 8, Rule 13 of the 1997 Rules of Civil Procedure, as amended.

It appearing that Atty. Jesus Montalbo has failed up to this late date to pay the fine of P1,000.00 imposed on him in the resolution of 14 July 1999 for failure to comply with the resolution of 22 March 1999 which required him to show cause why he should not be held in contempt for failure to file comment on the petition for review on certiorari fir respondents Letecia Hughes, Felix Villanueva and Natividad Sangalang and to file said comment pursuant to the resolution of 8 July 1998, the Court RESOLVES: (a) to IMPOSE on Atty. Jesus Montalbo an INCREASED fine of P2,000.00 payable to this Court within five (5) days from notice hereof or imprisonment of ten (10) days if such fine is not paid within the prescribed period; and (b) to REQUIRE Atty. Montalbo to COMPLY with the resolution of 22 March 1999 by submitting to this Court the required explanation and comment of aforementioned respondents on the petition also within five (5) days from notice hereof.
