Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated SEPT 27 1999.

G.R. No. 137551 (Atty. Charles D. Cole vs. Court of Appeals, et al.)

G.R. No. 138249 (Lolita D. Cole, et al. vs. Office of the President, represented by Gaudencio A. Mendoza, Jr., in his capacity as Assistant Executive Secretary for Legal Affairs of the Office of the President, Malaca�ang, Manila, et al.)

G.R. No. 139099 (Atty. Charles D. Cole, et al. vs. Julieta Agda.

After deliberating on the petition for review on certiorari with prayer for restraining order and/or preliminary injunction in G.R. No. 139099, the Court, without giving due course thereto, RESOLVES to require respondent to COMMENT thereon [not to file a motion to dismiss] within ten (10) days from notice hereof.

Acting on the motion of petitioners in G.R. No. 138249 for reconsideration of the resolution of 26 May 1999 which dismissed the petition for certiorari, prohibition and mandamus, the Court further RESOLVES to DENY the motion with FINALITY, no compelling reason having been adduced to warrant the reconsideration sought.

Petitioners': [1] supplemental motion for reconsideration of the resolution of 26 May 1999, [2] manifestation and motion in G.R. No. 137551 dated 25 July 1999 that the Court of Appeals instead of complying with the resolution of 7 April 1999 requiring respondents to comment on the petition for mandamus, issued a decision in CA-GR No. SP-45093 which he appealed to this Court and is now docketed as G.R. No. 139399, and praying that said decision be restrained from being enforced and the petition in G.R. No. 137551 be given due course, and [3] manifestation and motion in G.R. No. 139399 praying that the attached verification and certification be admitted and considered as an integral part of the petition are all NOTED.
