Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated SEPT 20 1999.

G.R. No. 138096 (Federico Felices vs. Hon. Francisco V. Mazo, in his capacity as acting Presiding Judge of the Regional Trial Court of Samar, Branch 31, Calbayog City, Julian Reballos, et al.)

Acting on the motion of petitioner for reconsideration of the resolution of 17 May 1999 which denied his motion for extension of time to file petition for review on certiorari for non-payment of the balance of the deposit for costs and lack of affidavit of service of the motion on respondents and the Regional Trial Court as well as a written explanation why such service was not done personally, the Court RESOLVES to DENY the motion with FINALITY, no compelling reason having been adduced to warrant the reconsideration sought.

The letter of petitioner dated 9 July 1999 remitting to this Court the amount of P420.00 as balance of the deposit for costs is NOTED, the petition for certiorari having seen dismissed and petitioner's motion for admission of said petition accordingly denied in the resolution of 28 July 1999.
